1. Provider and scope

These terms apply to the use of EpyxChat at https://chat.epyx.cc (the "Service"). The Service is provided by:

Kevin Wendel
c/o NORDINITY #63330
Norderkamp 1
24803 Erfde
Deutschland
[email protected]

By creating an account or by using an overlay created with the Service you agree to these terms. If you do not agree, please do not use the Service.

2. What the Service does

EpyxChat is a web tool for streamers. It combines live chat messages and events (for example subscriptions, bits, gifts, raids and channel point redemptions) from Twitch, Kick, YouTube and TikTok into one customizable chat overlay that you add to OBS or similar software as a browser source.

The Service is free of charge. We may add, change or remove features and platforms at any time, in particular when a platform changes or closes its interfaces.

3. Your account

You need an account to create chats. You sign up with a user name, a password and an e-mail address, which you have to confirm with a link before you can create chats. Where the Service offers it, you can instead sign up and sign in with your Twitch or Kick account. An account belongs to one person and must not be shared or sold. Everybody has one account: if you end up with two accounts, merge them on the account page.

You must be at least 16 years old or have the consent of your parents or legal guardian.

Keep your password secret. You are responsible for everything that happens through your account. Tell us at once if you suspect abuse. Please give correct information, in particular an e-mail address that you can read.

You can change your password, add or remove ways to sign in, merge your own accounts and delete your account at any time on the account page.

4. Linking platform accounts

After signing in you can link one or more accounts of Twitch, Kick, YouTube (Google) and TikTok. Linking is voluntary. It is done on the platform's own authorization page, where you see exactly which permissions are requested.

We only ask for read access that is needed to prove that a channel belongs to you and, for Twitch, to show channel point redemptions and follows in your overlay. We never post, chat, change settings or act on your behalf on a platform.

A chat can show the channels of accounts that you have linked and channels whose name you type in. A linked channel gets everything that needs the permissions of the platform app (for example follows and channel points on Twitch, or the official Kick API). For a channel that you only type in, a chat shows the public chat and the standard events, nothing more. Do not try to get around this. If a channel is not yours, you confirm that you may show it on your stream, for example because its owner agreed.

You may only link accounts that belong to you. You can unlink an account at any time on the account page and withdraw the permission at the platform (see the privacy policy).

5. Third-party platforms

EpyxChat is an independent project. It is not affiliated with, endorsed or sponsored by Twitch, Kick, Google/YouTube or TikTok. All names, logos and trademarks belong to their owners.

When you link or use a platform you also have to follow its terms: Twitch Terms of Service, Kick Terms of Service, TikTok Terms of Service and Google Terms of Service.

By using the YouTube features you also agree to be bound by the YouTube Terms of Service.

Platforms may change or stop their interfaces, restrict access or block connections at any time. We cannot guarantee that a platform keeps working.

6. Acceptable use

You agree not to:

  • use the Service for anything unlawful or in violation of the rules of a platform;
  • show chats of channels you are not entitled to show, or try to get around the account linking or other protections (for example to get features of a channel that is not yours);
  • attack, overload or disrupt the Service, or try to access the accounts, chats or data of other users;
  • sign up accounts automatically or in bulk, or send automated requests beyond the normal use of an overlay;
  • use the Service to harass, threaten or discriminate against others, or to show illegal content.

You are responsible for your stream and for what your overlay shows. Anyone who knows the link of an overlay can see it, so share the link only with people and software you trust.

7. Chat content

Chat messages, user names, emotes, badges and other content shown in an overlay come from the platforms and belong to their authors or to the platforms. We only pass this content on in real time and do not moderate it. You are responsible for moderating your chat and for complying with the law and with the platform rules when you show it on your stream. Settings such as hiding commands, bots or users help you but do not replace moderation.

8. Availability and changes to the Service

We run the Service with reasonable care, but it is provided "as is" and "as available". There is no guarantee of uninterrupted operation, of a particular uptime, or that every chat message or event is delivered or shown. Do not rely on the Service for anything that would cause serious harm if it failed.

We may change, suspend or end the Service. If we plan to end it completely, we will announce this on the website in good time where possible.

9. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and wherever mandatory law requires it.

In case of slight negligence we are only liable for the breach of an essential contractual obligation (an obligation whose fulfilment makes the proper use of the Service possible in the first place and on which you can regularly rely), and then only for the typical, foreseeable damage. Any other liability is excluded. These limits also apply to the personal liability of our employees and helpers.

10. Termination

You can stop using the Service and delete your account at any time on the account page. Deleting the account removes your chats, your settings and your linked platform accounts.

We can suspend or delete an account, or block access to the Service, if you seriously or repeatedly violate these terms, if the account is used to abuse the Service, or if the law requires it. Where possible and lawful, we will tell you the reason.

11. Changes to these terms

We may change these terms for good reason, for example because of new features, changed platforms or legal requirements. The current version is always available at https://chat.epyx.cc/terms. We will point out significant changes on the website or, if you gave us an address, by e-mail. If you do not agree with a change, you can delete your account before it takes effect; if you keep using the Service after that, the new terms apply.

12. Governing law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country where you live remain unaffected.
